Treasury puts sanctions on the table

Following the White House statement, Treasury Secretary Scott Bessent warned that sanctions and US Entity List restrictions could be considered against Chinese companies found to have taken American AI intellectual property.

What was actually announced

Nothing, in enforcement terms. The significant fact about this stage of the dispute is that no enforcement action has been imposed. Every consequence in circulation has been floated, threatened, or described as under consideration. Entity List placement is a specific administrative process with an evidentiary record behind it, and no such placement followed from these statements.

Why the threat is harder to execute than it sounds

Sanctions and Entity List designations are ordinarily built on documented conduct, a shipment, a transaction, a diverted item. The chips portion of the allegations against Moonshot fits that template, because restricted hardware moving through a third country is exactly the kind of fact pattern export-control enforcement is designed for.

The distillation portion does not fit it. There is no controlled item, no shipment and no export. There is a pattern of API traffic and a model that performs better than expected. Building a designation on that would require establishing both that extraction occurred and that a specific model resulted from it, and the second half of that has not been publicly demonstrated in any case so far.

What to watch

The meaningful signal will not be further statements. It will be whether any designation actually issues, and if one does, what evidentiary basis is cited for it. That would be the first time the distillation question was tested against an administrative standard of proof rather than argued in public.
