Moonshot releases the weights anyway

On 26 July 2026, a day ahead of its stated target, Moonshot AI published the weights for Kimi K3 publicly.

The significance of the timing

Four days after being accused by the White House of building the model through unauthorised distillation, Moonshot gave it away. Whatever the intent, the practical effect is that the model at the centre of a sanctions discussion is now freely downloadable and self-hostable by anyone.

What it does to the enforcement question

Open weights complicate the policy response considerably. Restrictions targeting a company’s API access or commercial operations do not reach a model that has already been distributed. Any capability the model has is now permanently in circulation, and no designation reverses that.

It also shifts the analysis question. With weights public, third parties can in principle examine the model directly rather than relying on behavioural probing. That does not resolve attribution, weight-space forensics remain unreliable and do not survive ordinary retraining, but it moves the argument from a closed system to an open one.

The unresolved position

This is where the dispute stands. An allegation has been made at the highest level of the US government. No evidence directly linking the alleged activity to the model has been published. No enforcement action has issued. And the model itself is now open, downloadable, and beyond recall.
